Income from Work as a Notary Public is Exempt from the Self-Employment Tax

The work of notaries public is in demand with all so many people buying or refinancing their homes. A notary must attest to many signatures in the closing of a purchase or refinancing of real estate. A notary public serves as a state official who is a bonded witness of a signature. In Florida and perhaps in other states, a notary public can also perform a marriage.

While the net income of a notary public is subject to federal income tax, it is not subject to self-employment tax. Section 1402(c)(1) of the Internal Revenue Code and Regulations Section 1.1402(c)-2(b) provide that the income of a notary public is not subject to self-employment tax.

If a notary public has another business as a self-employed individual, the notary public must pay self-employment tax on the net income from the other business. The notary public must keep a separate account of the income and expenses of each separate business.

A self-employed notary public reports the income and expenses from serving as a notary public on Schedule C of Form 1040. However, the net income from serving as a notary public does not go on Schedule SE because the net income from serving as a notary public is exempt from the self-employment tax.

If the taxpayer has erroneously paid self-employment tax on the net income from serving as a notary public in previous years, the taxpayer should consider filing an amended return on Form 1040X to claim a refund for all open years. In general, a taxpayer has two years from the time the taxpayer paid the tax or three years from the date the taxpayer filed the return, whichever is later, to claim a refund. Taxpayers should consult a competent tax professional before filing an amended return.

What Do You Do When Your Computer Crashes?

This past week I have experience a lot of lost and embarrassment. My computer crashed and I lost all of my files. Most of my affiliate ID's were memorized via the computer, so I had to get all of my ID's back manually. All of the helpful software that I downloaded to assist me with my online marketing was lost. I tried to restore my computer, but nothing seemed to work. So I made some calls to the manuafacturer (Gateway) to see what I should do. I was told that I needed to order software to download Windows Microsoft again. So now I have to wait 2-4 weeks for the software to arrive. In the meantime I am borrowing a laptop until my software arrives.

I truly believed that God had me to go through this experience as a lesson. The lesson I learned from this horrid experience is to have a back-up plan. Always have a back-up CD of ALL of your files. You can also download your files at ziddu.com just in case something happens to your files and do not happen to have a back up CD. And also always have a back up plan just in case your computer crashes and you do not have access at all. I found that the local library is an excellent back up plan. You may only be able to get on the computer at one hour intervals, but that is okay, because at least still have access. I do most of my marketing via the internet and most of my profits are made via the internet. So it is also a good idea to learn how to market and make profits offline as well, because you never know what may happen to your computer.

My suggest is to do a bit of research to find out how to market and make a profit offline as well. It will save you a lot of embarrassment and heartache, and you get to meet and interact with people on a more personable basis. I have made it a point to start doing both online and offline marketing.

Self Employement Tax

Who must may self-employment tax? If you are self-employed, you will be responsible for self-employment tax. For the purpose of determining self-employment tax, you are self-employed if you are a sole proprietor, an independent contractor, a member of a partnership, or are otherwise in business for yourself. As a self-employed individual you will have a Schedule C to attach to your Form 1040, and self-employment tax is computed on Form 1040, Schedule SE. Individuals must pay self-employment tax is they have net earnings of $400 or more. They are several sources of net earnings that are used when figuring your self-employment tax liability. In most cases, net earnings include net profit from a farm or nonfarm business.

If you operate more than one business, your net earnings from self-employment are the combined net earnings from all your businesses. If you have a loss in one business, it reduces the income from another. Self-employment tax is the self-employed individual's contribution to social security and Medicare taxes. The only difference between the employee and the self-employed is the employee's social security and Medicare taxes are paid half by the employee and half by the employer. When an individual is self-employed, he/she is responsible for the entire amount.

There are alternative methods that can be used for figuring liability of self-employment tax. The Farm Optional Method and the NonFarm Optional Method may qualify an individual to claim a larger Earned Income Credit or Child Tax Credit. They may also, however, increase your self-employment tax liability.

The maximum amount of earnings subject to self-employment tax is currently $87,000.00 and when figuring your adjusted gross income on Form 1040, you may deduct up to one-half of your self-employment tax liability. If you are member of the ministry or clergy you may request an exemption from self-employment tax from the IRS.

In summary, if you are self-employed, have net earnings of $400 or more, and file a tax return, you will be subject to self-employment tax.
